for a guess he is runing windows 7 beta as the score goes up to 7.9

Of course, if I wanted to I could upgrade to a c2d t9600, 4gb of ddr2 667, and a hitachi 7200rpm sata 3gb.

Here's weird one... I had a score 0f 5.9 until today. I added another 4 gigs of DDR2 800mz Corsair Ram to make 8 gigs total on my Asus P5N-D with Intel Core 2 Quad Q9300, Nivida 9800GTX + and ran the index again...it came back 5.7 that with added ram...go figure (LOL)

That does not seem right.
Did you check the Ram to make sure it's functioning correctly? Or is it possible it's the wrong type of Ram? Or ??? Weird...

Yes, new 4 gigs of identical RAM working fine. Total RAM system sees is 8 gig.
I ran index again and sure enough 5.7 instead of the previous 5.9.
Doesn't bother me, but may show that index is falwed in testing and results.

All drivers including Nivida motherboard and video card up todate, all windoze updates applied, very clean system with 2 fast SATA hard drives, 1 drive left empty as scratch disk for photoshop.

It's nothing wrong w/ the RAM or your system. Windows still hasn't much of anything that actually is written to utilize/access 8 GB of RAM. There's still the 'sweet spot' of between 2-4 GB on most systems. I get a 5.9 on my RAM but I only use 6 GB. At 12 GB, it drops a little, as well, but nothing yet uses that much. The only thing I've seen so far (that I use) are Adobe Photoshop CS4 x64 (and there aren't 64 bit plug-ins yet) and I've tried but don't use the extremely well-written newest Auto Desk line of products. :D
