Privacy Policy
OVERVIEW
1. General Matters
1.1 Overview.
Protecting the privacy of our users is a top priority. For this reason, AGCM, Inc., an American Greetings subsidiary, ("AGCM", "we" "us" "our"), the company that runs this website ("Site"), has adopted the following Privacy Policy to advise you of your options regarding the use of your personal information. By using this site, including any free products, you agree to be bound by this Privacy Policy, the <link removed> and, when applicable, the Terms of Sale. We reserve the right to change this Privacy Policy at any time without notice. Because you are bound by this Policy, you should periodically visit and print the latest version of this Policy for your records. The date of the last update to the Policy is at the top of this page.
1.2 Scope.
This Policy only applies to the Site and does not apply to other companies or organizations, even if links to those companies or organizations appear on the Site. You should review the policies of those companies or organizations to determine how they treat any personal information you provide them.
2. Collection of Personal Information
2.1 Personal Information.
(A) What we collect
. In order to provide you with the services ("Services") available on the Site, we collect personal information about you, such as your name, email address, phone number, postal address, credit card number, date of birth and so on. We also collect any text you insert into the products. Because of the nature of the Services may also access and may save information from your social expression account (for example, your MySpace account), such as your user name, password, gender, and date of birth. We do not sell, trade or rent any of this information to Third Parties.
(B) Use of Third Parties
. We reserve the right to give your personal information to Third Parties that are performing services for us, but those Third Parties will not have the right to use your personal information for any other reason, or to transfer, sell, trade or rent your personal information for any reason.
(C) The AGCM Family
. Additionally, AGCM is part of a family of companies that includes AmericanGreetings.com, BlueMountain.com, eGreetings.com, PhotoWorks.com, Webshots.com, Carlton Cards Retail, Inc., Plus Mark, Inc., Gibson, Guildhouse, and Designware, among others. We reserve the right to share personal information with the other companies in our family in order to conduct promotions, offer special premiums, and share databases and equipment. We will NOT share your billing or credit card information with anyone, including our sister companies, without your permission.
2.2 Surveys, Sweepstakes, Contests, or Drawings.
We may, at times, offer you a chance to participate in a survey, sweepstakes, contest, or drawing. In order to participate, you may be required to disclose personal information. We may share the information we receive in this way with parties conducting research studies, even if this information overlaps with the information described in section 2.1.
2.3 Your Experience.
We may ask you, or have a third party company ask you, to share information about your experience with our products. We may use this information in the following ways:
(A) to notify you that you have won the sweepstakes, contest, or drawing; (B) to conduct market research studies and reports; (C) to give to companies that co-sponsor the sweepstakes, contest, or drawing with AGCM; or (D) to send you information about our products. 2.4 Non-Personal Information.
(A) Aggregate Data
. We generally collect generic information about customers' use of our Site, such as the number of unique visitors, the frequency with which customers visit the site, and the areas on the Site that customers favor. These statistics are very much like television ratings that tell networks how many people tuned in to a program. We only look at these statistics in a compiled form, not on an individual customer basis. This data helps us determine which parts of the Site are most used and, in turn, helps us make the site as appealing to the customer as possible. We may also supply statistical "ratings" about how customers use the Site to advertisers, sponsors and other companies with which we do business ("Business Partners"). We do this so they, too, can understand how often and in what manner customers use the Site. These ratings and statistics do not include any personal information about you or any of our customers.
(B) IP Addresses
. An Internet Protocol ("IP") address is a number automatically assigned to your computer whenever you are surfing the Web. Web servers automatically identify your computer by its IP address. When you use the Service, our servers log your IP address. We do not normally link IP addresses to anything personally identifiable, which means we log the visitor's session, but the visitor remains anonymous to us. We collect IP addresses for the purposes of system administration and to audit the use of the site. We also use IP addresses to collect statistical information to send to our advertisers and for other marketing and promotional purposes.
(C) Web Beacons and Pixels
. We may also place web beacons or pixels on the site to track traffic and usage. Information collected through these devices is aggregate and not linked to any personally identifiable information.
2.5 Cookies.
(A) What are cookies?
We use a technology called "cookies" in connection with the Service. Cookies are data or information sent to your browser from a web server and stored on your computer's hard drive for record-keeping purposes. AGCM uses cookies to make your use of the Service more convenient. (B) How can you disable cookies?
Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, some parts of the Site will not function properly or may be considerably slower if you refuse cookies. For example, without cookies, you will not be able to take full advantage of AGCM's services, or you may have difficulty filling out surveys. (C) Third Party cookies
You may occasionally get cookies from other parties when you visit our web site. We do not control these cookies. The use of cookies sent by Third Party servers is standard in the Internet industry. (D) Advertising research cookies.
From time to time, Third Party research companies may place cookies on your browser regarding exposure to certain advertisements. These cookies may be used later for research purposes if you choose to take a survey. If you choose to take a survey, the research company may examine your browser to see if one of their cookies has been set. If the research company detects one of these cookies in your browser, it will gather only two pieces of information from it: (1) where you have seen a particular ad, and (2) how many times you have seen it. 2.6 California Residents.
California Civil Code Section 1798.83 permits residents of California who are visitors to the Site to request information regarding our disclosure of their personal information to Third Parties for marketing purposes. To make such a request, please send an email to <link removed>.
3. The Kiwee Toolbar
The Toolbar automatically sends only standard, limited information to AGCM, which may be retained in AGCM’s server logs. It does not send any information about the web pages you visit (e.g., the URL).
3.1 GUIDs.
Your copy of the Kiwee Toolbar includes a unique application number (a “GUID”). When you install the Kiwee Toolbar, this number and a message indicating whether the installation succeeded are sent back to Kiwee. Also, when the Kiwee Toolbar automatically checks to see if a new version is available, the current version number and the unique application number are sent to AGCM. The GUID is required for the Kiwee Toolbar to work and cannot be disabled.
We also tag each toolbar with a GUID, which tracks your activity and the search terms you insert into the toolbar. Again, this information is not tied to any personally identifiable information about you.
3.2 Search Queries.
The Kiwee Toolbar, in the course of processing a given search query, sends a request to our servers. This request includes the keyword query, time of day, browser type, default language setting, IP address, the GUID, and a code that identifies the marketing or distribution source of the toolbar used by you to conduct your search. If the search query is being generated as the result of a misspelled URL or search term entered in to the browser address bar, we also receive the misspelled URL address or search term. We use this information in order to properly process your search request. For example, this data provides us with: information on which language you prefer to use; aggregated click information for the purpose of ensuring that our search partners are appropriately compensating us; information that allows us to make accurate payments to our distributors; aggregated usage and retention information; and aggregated search query information for the purpose of further monetizing commercially oriented search keywords. All information collected from a search query is recorded on a non-personally identifiable basis and is kept strictly anonymous. In addition, all information about search activity is evaluated only on an aggregate basis (excepted in response to a customer service inquiry or legal process).
3.3 Partnership with Microsoft.
As a Microsoft Live partner, any personally identifiable information we collect will be jointly owned by Kiwee and Microsoft Corporation. For information about Microsoft Corporation's privacy practices go to the MSN privacy statement.
4. Communications
4.1 From AGCM.
We reserve the right to communicate with you from time to time about important administrative, policy, legal, credit card, and billing matters that will affect your use of the Site, including any alleged violations of our <link removed>. These communications are mandatory and you cannot opt out of them.
4.2 Communications From Business Partners.
From time to time, we may offer you promotions, discounts, and other offers from our Business Partners. These communications may come from us or from the Business Partners directly. This program is conducted strictly on an opt-in basis. In order to receive the offers, you must check the clearly marked box on the payment order pages. If you do sign up to receive offers, we may share with our Business Partners certain demographic, geographic, preference, and other personal information about you in order to direct you offers more likely to be of interest. We will not share credit card or billing information with Business Partners without your express permission.
If you sign up to receive the offers but later change your mind, you may opt-out by following the procedures listed under "Editing Your Personal Information" below.
5. Editing Your Personal Information
5.1 Current Information.
You are responsible for keeping all of your personal information up to date and maintaining the confidentiality of all personal information and your password associated with the Service.
5.2 Changing Your Status.
At any time, you may change the choices you have made about the use of your personal information. Every non-mandatory communication we send you contains a clearly worded opt-out or unsubscribe link allowing you to withdraw your permission for future mailings. Additionally, you may unsubscribe by sending a blank email to <link removed> with the word "unsubscribe" in the subject field. This system is automated and must be contacted from the email address to you wish to have removed. Please allow five to seven days for us to remove your email address. Unsubscribing will not have any effect on any information you have provided that we shared with Business Partners before you unsubscribed.
6. Disclosure
We reserve the right to disclose your personal information if we are required to by law or if we believe that such action is necessary. Circumstances under which we may disclose your personal information include, without limitation:
(A) compliance with a legal process, such as a search warrant, subpoena or court order; (B) protection of our rights or property; (C) investigation of reports of a user sending abusive, harassing or threatening messages or using a false email address; (D) protecting against the misuse or unauthorized use of the Service; (E) investigating reports of credit card fraud or unauthorized use; and (F) during emergencies, such as if we believe that someone's physical safety is at risk. 7. Security
7.1 Online.
When you use the Service or access your payment information, we use an advanced encryption technology known as Secure Socket Layer (SSL) to protect the storage and transfer of your data from unauthorized parties. While on a secure page, such as our registration form, a lock or key icon appears on the bottom of your web browser screen.
7.2 Off-line.
We restrict all visitor information in our offices. We grant employees access to information on a need-to-know basis (for example, a billing clerk or a customer service representative). We keep the servers on which we store personal information in a secure environment, behind a locked cage. We operate the Service's main servers from a dedicated Internet hosting facility with state-of-the-art physical security features, including smoke detection and fire suppression systems, motion sensors, and 24x7 secured access, as well as video camera surveillance and security breach alarms.
8. COPPA
We do not collect any personal information from users whom we know to be under the age of thirteen. AGCM complies with the requirements of the Children's Online Privacy Protection Act.
9. Transfer Of User Information
9.1 Our Use of Information.
Generally, we use the information you provide to process transactions, deliver you content, and operate the site. We endeavour to collect the minimum necessary to accomplish those purposes.
9.2 Third Party Service Providers.
We may also retain third party contractors to process electronic transactions, to deliver newsletters or other e-mail, provide storage and backup, or provide other services necessary for the operation and administration of the Kiwee sites. We contractually require these third parties to maintain the confidentiality and security of your personal information, to use it only for the authorized purposes and, not to forward it to any third party. Other than as set forth above, we will not share your personal information with any third party without your permission.
9.3 Transfer of Data Outside of the European Union.
Personal information collected on the Kiwee sites may be stored and processed in the United States or any other country in which Kiwee or its affiliates, subsidiaries or agents maintain facilities. By using the Kiwee site, you consent to any such transfer of information outside of your country.
9.4 Other Information Collectors.
This Privacy Policy only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, such as outside links to other sites, different rules may apply to their use or disclosure of the personal information you disclose to them. Since Kiwee does not control the privacy policies of third parties, you are subject to the privacy customs and policies of that third party.
In the event that AGCM or substantially all of its assets are sold or acquired, we may transfer the Site, the Service and all information collected by the Service to the acquiring party. In any such transfer, however, your information will remain subject to any terms and conditions applicable to the Site at the time the information was collected, including the terms of the then-current Privacy Policy.
